Police in West Virginia have charged a man and his step daughter with ? despite the fact that they aren't related by blood and are both over the age of consent and they now face up to 15-years in prison.

Nicholas County authorities charged Kelcey Nicholas, 28 and his 21-year-old stepdaughter Lataura Jarrett with ? after Sheriff David Hopkins decided to cite the inclusive definition of 'daughter' in state law.

Nicholas married Jarrett's mother five years ago and authorities allege that she calls him 'father', and the pair were arrested having sex after Sgt. W.K. Shafer and State Police Cpl. D.P. White traveled to their home on September 19th to arrest Nicholas for a home confinement charge
Making sure that he was working within the law, Shafer went to Nicholas County Prosecuting Attorney James 'P.K.' Milam, Hopkins to clarify the definition of daughter in West Virginia law.

According to state law, a daughter is the natural daughter of a person's husband or wife -- and Nicholas is still married to Jarrett's mother, Hopkins said.

The two were charged with seven counts of ? , which under West Virginia law carried a penalty of anywhere between five and 15 years in prison.

A trial date has not yet been set and Nicholas is still languishing in jail on $70,000 bail while Jarrett is free on bond and will appear in a preliminary hearing on October 3rd.

It's unclear if either has an attorney.
