Cop Followed Black Family Home And Held Them At Gunpoint For No Reason

A lawsuit filed in federal court on Wednesday accused the San Jose police department of racially profiling a black family and then holding them at gunpoint in front of their 7-year-old child for no reason.

According to a lawsuit obtained by The San Jose Mercury News, Emmanuel Stephens and his wife, Jasmine Whitley, had just picked up their 7-year-old daughter from school when Officer Alexander Keller began following them.

The lawsuit said that Keller followed the family to their home where he jumped out of his patrol car and drew his weapon on them. Keller allegedly placed Stephens in handcuffs and threatened to send their 14-year-old child to Juvenile Hall if she tried to record the incident with a cell phone.

According to the lawsuit, officers searched the family’s vehicle without probable cause. Whitley was cited for a small amount of medical marijuana even though she produced proof of a prescription.

The couple was later told by another officer that police had received calls about “suspicious black man with a purple backpack.” The suit, however, a.sserted that Stephens did not have a purple backpack and that it would have been impossible for Keller to see one inside the car even if he did.

Attorney Paul B. Justi, who is representing the family, pointed out that this case could have turned deadly like so many other recent tragic encounters between police and minorities.

“What happened to my clients happens all the time and is a real problem,” Justi explained. “This type of police misconduct only gets attention when someone ends up dead, but this type of non-lethal harassment is much more widespread and also need to be brought to light and stopped.”

Earlier this year, the San Jose Police Department was sued by a black man who said he was stopped repeatedly for minor traffic violations because of his skin color.

    The irony of your screen name being what it is and how your logic disrespects who it's derived from. The only ? ? here is yourself. And while economic empowerment is important to our cause, if you believe that it's the only thing that matters then you're not only a ? , but oblivious and naive as well. There are multiple issues that need to be resolved and contrary to popular belief, money will not fix all of them. It is not the end all be all.

    They lived in Almaden Valley which is one of the nicest neighborhoods in SJ. More than likely somebody got jealous and called the police on them. The police being hyper vigilant likely ? with them and went overboard. I lived in San Jo several years and moved out and will never move back because of the police, the property crime rate, and how the police handle the people. For what you pay to live in a nice area there, it's not worth it.

    smh that 14 y/o ? had no heart. He shoulda had that phone out as SOON as ? got real and told pig to shoot him if he ain't like it. If Officer Slager taught us anything it should be that phones are more effective than guns against the police in the country. (For now, at least....) That phone could be the difference between you getting justice or getting lost in the belly of the beast. We all watched as cell phone videos toppled dictators during the Arab Spring. This new ability of impoverished masses to document injustice and disseminate it to the entire world for free is unprecedented in human history. ? use it.

    I guess folks don't like this answer but the man has a point. You'll never see someone dead to rights throwing a fuss when approached by police. It simply isn't wise. You don't want to make ? worst as it can possibly be, so comply within your rights and keep your mouth shut. You increase your chances of survival and gain rope to hang them with later in court possibly.

    Remember, their goal is for the suspect to give them a reason and the majority of their procedure is baiting tactics.

    Police pulling a black man over is the equivalent of a soldier caught behind enemy lines as one man put it. You'll know when you encounter a cop out to ? and in that case by all means fight for your life. But if that aint the case take the L and fight it another day... not on the killing field.

    I'm usually under the thought train that the cameras are just exposing what's already been going on but I'm currently changing my mind that they must be becoming More brazen and stupid.
    There's a new report of an officer shooting a (white) guy in the back during a drug sting and didnt even file it in the police report.

    The cat in Walmart too. Hell that Indian man that got paralyzed by a cop bodyslamming him was put in that situation because someone called in saying a strange black man was walking up and down the street.

    These are simply anecdotes on a public website. But they illustrate an aspect of the relationship between cops and minority communities that doesn't get much attention.

    In stories like Ferguson and Baltimore, we tend to focus on the relationship between police and minority communities as if it were purely binary and took place in a vacuum. But the Reddit thread shows that cops can become frustrated by the frequency with which some members of a community -- most likely white people -- call the authorities.
