Chicago cop says he was threatened by mom of man he fatally shot

CHICAGO — An attorney for a Chicago police officer who was cleared of criminal wrongdoing earlier this month for the shooting death of 25-year-old Ronald Johnson is asking a federal judge to sanction Johnson's mother for allegedly threatening the cop.

Officer George Hernandez shot Johnson in the back as he fled police in October 2014, but Cook County State's Attorney Anita Alvarez announced on Dec. 7 that the officer would not be charged in the shooting that was caught on grainy police dashboard video.

Alvarez concluded that Johnson was holding a gun at the time of his death, and that the deadly use of force was justified. Johnson's family, however, dispute the prosecutor's conclusion and claim that police planted the firearm on him after he was shot.

Now, attorneys representing Hernandez in a wrongful death lawsuit filed by Johnson's mother, Dorothy Holmes, say that the mother has threatened harm to Hernandez and his children. Hernandez and the city of Chicago are defendants in that lawsuit.

"You forgot, I love my kid just as well as he loves his 15-year-old and his 17-year-old. What goes around comes around. And he can take it how he wanna take it," Holmes said in comments to protesters a day after Alvarez's announced her decision. "If he wanna take it as a threat, it was a threat. And I ain’t backing down."

Holmes also allegedly took a photo of Hernandez surreptitiously in November, while the officer was giving deposition in the civil lawsuit and then posted it on her Facebook page "with highly charged derogatory comments," according to a court filing by Steven Borkan, Hernandez's attorney.

Borkan says in the filing, which is dated Dec. 10, that Holmes removed the photo from her page after Hernandez's defense team complained to Holmes' attorney. But the photograph continued to pop up on social media with derogatory comments about Hernandez.

"To prevent this conduct from escalating further than it already has, we respectfully ask this Court to sanction Plaintiff in open court for her threats," Borkan requests in the filing. "We further request that Plaintiff be ordered not to disseminate personal information regarding Officer Hernandez and his family."

The announcement by Alvarez that she would not charge Hernandez came just two weeks after the city was forced by court order to release another police video that showed Officer Jason Van ? shoot Laquan McDonald 16 times during an incident on the city's Southwest Side.

Van ? was charged with first-degree murder by Alvarez's office on the same day as that video's release, which has ignited weeks of protest in the city as well as calls for Alvarez and Mayor Rahm Emanuel to resign from their posts.

"Here, Plaintiff’s most recent statements, juxtaposed with the current political climate, are extremely serious as they endanger the lives of two minor children, who are not parties to this lawsuit. It is akin to yelling fire in a crowded theater," Borkan writes in the filing requesting sanctions against Holmes. "This conduct is egregious as it arguably rises to criminal conduct under Illinois statutes."

Michael Oppenheimer, Holmes' attorney, said Holmes comments were reflective of her emotional state.

"This was a grieving mother that was upset that the state's attorney would not file charges against the police officer who killed her son," Oppenheimer said. "This was not meant as a threat. She lost her own child. She's not going to threaten someone else's.
