The Arizona Republic reported today that Federal Judge Susan Bolton has issued a preliminary injunction blocking key provisions of Arizona immigration law SB1070 from going into effect as scheduled on July 29, 2010. The purpose of the preliminary injunction is to allow all of the lawsuits to be properly litigated before allowing the law to take effect.
The parts of SB1070 that are subject to the injunction are:
1. The provision requiring state and local law enforcement officers to detain and question people whom they have “reasonable suspicion” the person is an “illegal alien” until the person can prove they have permission to be in the United States;
2. The provision which makes it a state crime to forget to carry your proof of immigration status at all times;
3. The provision that criminalizes the act of looking for and/or performing work by undocumented immigrants (except the part that outlaws day laborers seeking work on the side of the road or in parking lots);
4. The provision that allows state and local law enforcement to arrest, without a warrant, a person who the officer adjudges to be guilty of a deportable offense.
The provision that makes harboring and/or transporting undocumented immigrants was not included in the injunction.

Plaintiffs include the U.S. Department of Justice, the American Civil Liberties Union, Phoenix and Tucson police officers, municipalities, illegal immigrants and non-profit groups.
