Drug Lord ‘El Chapo’ Can Be Extradited To U.S., Mexican Judge Says

A Mexican federal judge has ruled that reputed drug lord Joaquin “El Chapo” Guzman can be extradited to the United States, according to a Monday news release from the Mexican Federal Court.

The decision was in response to a U.S. Department of Justice extradition request. The ruling does not immediately pave the way for the Sinaloa Cartel boss’ extradition.

Guzman was transferred last week from the maximum-security Altiplano lockup in central Mexico to a prison in Ciudad Juarez, a senior Mexican law enforcement source told CNN.

“Due to the proximity (to the U.S.), it makes it easier to extradite him,” the official said.

The exact reason for the move was unclear, but it comes one month after a Mexican lawyer leading his legal defense team said his client wanted to be extradited to the United States “as soon as possible” because conditions at Altiplano were unbearable and making him seriously ill.

Altiplano is the same lockup near Mexico City from which the drug lord escaped in July and to which he was returned after his January 8 recapture in the coastal city of Los Mochis in Sinaloa state.

The United States has been preparing for Guzman’s transfer for months and has been hammering out the security details, American officials said.

It’s not immediately clear when Guzman will be turned over to U.S. custody, but once he is transferred, Guzman will be sent to Brooklyn, to stand trial on federal charges, the officials told CNN.

    Yeah the federal prison he in now is supposed 2 be one of Mexicos worst. It's a few miles away from Juarez.

    Joaquin :El Chapo: Guzman was incarcerated in the Cefereso No. 9 where four of his alleged accomplices were also transferred last January after his recapture in Los Mochis, Sinaloa, among them the leader of the Sinaloa Cartel gunmen, identified as Ivan Gastelum Avila, "El Cholo Ivan".

    According to unofficial sources, Gastelum Avila is facing charges of homicide, crimes against health, in the form of possession of marijuana, possession and trafficking of ? and ? , unlawful possession of firearms intended for use by the Army, Navy and Air Force, possession of cartridges amd carrying a firearm without a permit.

    In January, El Chapo was recaptured along with four men and two women, the (Mexican) Office of Attorney General reported (PGR).

    At that time, the men were incarcerated in the Cefereso No. 9 in Juarez, while the women were taken to the prison in Morelos.

    The PGR did not release the names of those incarcerated not the Federal District Court they were assigned to. However, it was learned that El Cholo and three other men who were detained in Los Mochis were among them.

    But, in addition to his accomplices, El Chapo is incarcerated with members of adversarial gangs, such as Aztecas, the enforcement arm of the Carrillo Fuentes (Cartel), with whom he has fought to the death for control of that area used for trafficking drugs into the United States, as well as members of Los Zetas, who have been transferred from other parts of the country, which has triggered an alert by prison authorities.

    Then his lawyer applied those appeals knowin they take a year to be accepted or denied and there nine.of them so he pretty much playin games but theres no way he steps foot in u.s. soil this move is smoking screens either he gonna escape or die in that new prison cuz lately they been sayin alot of his.leaders been moving to juarez thats why he complaint how he was being treated to get moved and said go head with the extradition to switch prisons so lets see

    The Secretary of Exterior Relations now has 20 days to determine if to grant the extradition, or not, of Guzman. The capo's defense team can promote an amparo judgment to challenge his move, this could postpone by weeks or months, the transfer of the capo to United States authorities.

    Guzman first was notified of the determination of the Judge on Sunday night, the associated press was told that a judicial authority, who he was not authorized to identify because of internal policies, prevent you from giving details of processes that are in course.

    Guzman, considered the leader of the Sinaloa Cartel, was suddenly transferred on Saturday from the maximum security prison "Altiplano" to Juarez Cefereso #9 closer to the border with the United States, even though the Government has said that he was not moved due to the extradition process, but because of measures to upgrade the security of "Altiplano".

    Guzman's lawyer, Jose Refugio Rodriguez, said to the AP that the Government would seek to hide his extradition, "that is their legal strategy", he commented via telephone. He also said that once the Foreign Ministry resolved the extradition, the defense has 30 days to promote the amparo.

    Also, Rodriguez said that they will seek to have Guzman returned to "Altiplano", under the argument that the transfer at the weekend affects his proper defense, in due course, because the Judge who is dealing with their process is not near the prison where the capo is now being held.

    Yesterday, El Chapo's lawyer, Andres Granados said to Univision, that the day of the transfer the capo didn't understand what was happening, nobody had given him an explanation. His only thought was that the day of his extradition to the United States had finally arrived.

    " I thought that I was going to go and eat hamburgers", Joaquin Guzman Loera jokingly said on Sunday to Andres Granados.

    Granados related the conversation that he had with his client, Guzman Loera, after being transferred to the Ciudad Juarez prison: " he said to me that they arrived in the morning, and that they said to him " we are going to get revenge here". They took him from his cell, they handcuffed him and took him away. When they were leaving he heard the helicopters and he said to himself " now I will be extradited". Until he arrived here, first at Ciudad Juarez Airport and then a transfer to Cefereso #9".

    The soap opera continues. Nothing in the past has made any sense, other than the drama continues. All I can say if something unexpected happens, it mean the next chapter is about to play out. Nothing should be ruled out and as we have learned from Chapo, anything is possible. I tend to go with the fake death of Chapo and the DEA or CIA relocating him in the USA for his retirement. He's to big and to rich and he's worked hand in hand with both governments. It won't surprise me if the guy being jailed and moved isn't even the real Chapo. I think both governments just want a nice end to the story were they both come out looking like good guys and Chapo has a nice quiet retirement.

    To simply ? off whoever it is in the states that wants him and my personal amusement.

    He's killed, extradited, or in a Mexican prison for the rest of his life. I really don't care either way.
