Prosecutors don't charge Chicago cop who fatally shot 2, 1 by mistake

The Cook County State's Attorney's office said Friday that no criminal charges would be brought against the Chicago police officer who fatally shot a baseball bat-wielding teen and — mistakenly — a mother standing by him.

An afternoon statement issued by the office said prosecutors found insufficient evidence to prove beyond a reasonable doubt that Officer Robert Rialmo did not act in self-defense.

State's Attorney Kim Foxx played no part in the decision because her previous employer — a Chicago law firm — represents the family of one of the victims in a pending lawsuit, the office said.

The shooting occurred about 4:30 a.m. the day after Christmas 2015 as Rialmo and his partner were responding to calls of a domestic disturbance at an apartment in the 4700 block of West Erie Street.

According to Rialmo's initial account — given to detectives about an hour and a half after the shooting — neighbor Bettie Jones had answered the door and pointed the officers to an upstairs apartment. As she turned to walk back to her unit, Quintonio LeGrier, 19, emerged from the doorway brandishing a bat over his head, gripped in both hands, according to Rialmo's account.

Rialmo said he started backing down the stairs and drew his service weapon while ordering LeGrier to drop the bat. In fear of his life, Rialmo said he opened fire three or four times. LeGrier grabbed his chest, uttered an expletive and collapsed.

Rialmo said he was standing at the base of the porch stairs by the time he stopped firing. When he returned to the porch, he saw Jones, 55, lying on her back with her legs sticking into the vestibule.

    Under Illinois statute, a judge or jury would have needed to conclude that Rialmo did not reasonably believe that he or his partner were in imminent danger of great ? harm. The baseball bat LeGrier was wielding also may be considered a deadly weapon under state law.

    “Similarly, the evidence does not support a prosecution for the death of Bettie Jones,” Eric Sussman, the first assistant state's attorney, wrote in a four-page report explaining the findings. “Under Illinois law, when an individual acts in self-defense and accidentally kills a bystander, he is not criminally liable for the bystander’s death.”

    Kim Foxx, the Cook County State's Attorney, was not in office at the time of the incident. She left Sussman in charge of the case, because the law firm she worked for before being elected county prosecutor is representing Bettie Jones family in a civil lawsuit against the city.

    Autopsy reports showed that LeGrier was shot in the chest, back, right buttock, left arm, and grazed on his left side and right shoulder. Jones was struck in the chest once.

    After calling police, LeGrier's father called his downstairs tenant Jones and asked her if she would let police into the building when they arrived. Jones agreed, but against the wishes of a friend who was with her in her apartment, according to the report.

    When police arrived at the scene, the report said Jones pointed police upstairs to guide the officers to the right location. At that point, LeGrier was coming down the stairs and heading toward Jones.

    Jones appeared "to step back into her apartment; at which time, police fired shots in an attempt to stop Quintonio," the report said.

    Rev. Marshall Hatch, a Chicago pastor who delivered the eulogies at the funerals of Jones and LeGrier, expressed outrage at the prosecutor's findings.

    The finding of "a justifiable double homicide of a questionable victim and an innocent victim will not go down well in our community," Hatch said. "Nor should it."

    It sounds like reckless manslaughter at least. He had to be shooting all over the place to hit Ms Jones. He shot her in the chest so he had to see her. I can't understand how he is not charged with that. She posed no threat.

    This 2 is kinda different , the father called and said his son was threatening him with a bat, when police came I'm guessing he had the bat they told him to drop it and he didn't, the lady was behind the door, and was shot by accident. Another thing is the son called police a couple times also.They said he been acting strange lately, I think it's a case of mental illness and there should be a department of the police force that handles mentally disturbed people to preserve their life. If someone is having a mental episode they should not be put to death, becuz of their condition they have no control over

    You sound naive. When dealing with white people they seem to always know how to handle a situation accordingly. They know exactly what they're doing, don't give them the benefit of the doubt.

    Don't make sense for the cops to just come blasting, our people get held to a different standard yes and u better realize that before u dead, but cop just come up shooting no theart to him is crazy, once again people don't call police on your crazy relatives, call that uncle or aunt that can get across to him, police job is full in chicago , they don't have enough time to go through who crazy and who just had to much to drink or smoke, I agree they shouldn't been killed but this is chicago, no black lives don't matter and yes the police trying to go home at night to their family, stop calling the cops on yours, his mental illness didn't happen over night

    Cops just killed some 55 year old middle aged white lady with a knife. They supposedly tasered her twice and nothing happened, so they shot her in the stomach and she ended up dying.

    This lady look frail from the picture they posted of her and I wouldn't take a 55 year old woman with a knife serious. She's damn near a senior citizen. could of batooned her in the back of the head.....smh
