In order to appear on that list he'd have to have a conviction on this charge. At the time he had no priors, and only 3 months had passed between his arrest and when you checked. With the court systems being slow as they are, I'm pretty sure that wasn't enough time for an eventual conviction to hit his record. That's if he was ever actually convicted for it.
