    The lawyer for the Chicago police officer who fatally shot 17-year-old Laquan McDonald defended his client Friday, saying the officer feared for his life and video of the shooting about to be made public doesn't show how the entire incident unfolded.

    Daniel Herbert, who represents Officer Jason Van ? , insisted the shooting was justified and that his client's actions fell within police department guidelines even though several other officers at the scene did not open fire.

    "I can't speak why the (other) officers didn't shoot," Herbert told reporters from his West Loop office. "But I certainly can speak to why my client shot, and it is he believed in his heart of hearts that he was in fear for his life, that he was concerned about the lives of (other) police officers."

    The shooting was captured on a police dashboard cam. The video is said to show the officer firing 16 rounds into McDonald's body, many as he lay prone on the ground.

    Herbert's comments came a day after a Cook County judge ordered the video released after finding the city had failed to prove that making it public would jeopardize any investigation.

    Within hours, the city did an abrupt about-face, dropping its court fight and saying it would comply with the judge's order by making the potentially inflammatory video public before Thanksgiving.

    McDonald, who was later found to have ? in his system when he died, was acting erratically and refusing police commands to drop his knife, records show.

    Officers trailed McDonald for nearly half a mile, from a trucking yard where he had been breaking into vehicles through the parking lot of a Burger King and onto busy Pulaski Road. As officers awaited backup units armed with Tasers, they tried to corral McDonald to keep him away from passers-by. At one point, McDonald used the knife to slash the front tire of a squad car trying to block his path.

    Within moments of arriving at the scene, Van ? jumped out of his squad car with his gun drawn and opened fire on McDonald, city officials have said.

    Lawyers for the McDonald family said the officer emptied his semi-automatic firearm. None of the five other officers there fired a shot, according to city officials.

    Almost everyone who has seen the video says the images are graphic and show McDonald being repeatedly shot while lying on the ground. The video reportedly shows McDonald's body palpitating quickly several times, consistent with shots striking. Even defense attorneys for the officer involved admit the video is not easy to watch.

    "The video is graphic, disturbing and difficult to watch, as any video of a man being shot to death would be," Daniel Herbert, the officer's attorney, told the Chicago Tribune.

    Herbert told CNN on Friday that before his death, McDonald had "punctured a tire on a police car."

    "At the point which my client confronted Mr. McDonald, my client was aware of the fact that the individual (McDonald) had not complied with numerous police orders to drop the knife," Herbert said.

    Herbert defended Van ? 's actions, saying the officer "believed he was in fear for an attack and for the safety of anyone else on the scene."
    Herbert, Van ? 's attorney, would not speak with CNN about which authorities are investigating the shooting.

    "He's scared to death, but more than himself he's scared for his wife, his two kids," Herbert said of Van ? . "He knows in his heart of hearts that his actions were appropriate."

    CHICAGO (WLS) -- Cook County State's Attorney Anita Alvarez said a decision "is expected next week" on whether to charge a Chicago police officer in a fatal shooting recorded on dash cam video.

    The video shows black teenager Laquan McDonald getting shot 16 times by a white officer on October 20, 2014. Some of the bullets entered the teen's back.

    State's Attorney Alvarez said she is not opposing the release of the video, which a judge ordered should happen by next Wednesday. Friday at 10 p.m. ABC7 Chicago incorrectly reported that the state's attorney "had declined charges in this case." Alvarez never said her office had declined charges, and on Saturday she said a decision is expected next week.

    Police said the 17-year old who was killed threatened them with a knife and slashed at the tires and windshield of a patrol car.

    I'm sure the Feds finally coming to decision next week.. right after a judge ruled for that tape to released is just a perfectly timed coincidence...

Your whole job is to protect and serve you can't tell me that one man with a knife put all the officers life in that much of a threat that only one couldn't think straight

    You're right, but that is the paradox of the phrase 'national security'. If a lie can keep the country in order as is, the truth is not desired...

    In the interest of national security......, the information needs to be suppressed (redacted).
    In the interest of not causing unrest, the truth needs to be buried so you can live more happily in the lie.
    Yet you living happily in the lie without the correct information can set you up for failure in the long term.

    Leaders in Chicago's African American community are calling for calm ahead of what could be a contentious week, as the city must release a video showing a white Chicago police officer killing an African American teen.

    Nearly 200 strong they came together Saturday to call for peace. Neither the cold nor the snowy weather was going to stop the men of Alpha Phi Alpha, an African American fraternity which counts many of the city's leaders among its ranks.

    "We want people to see the positive professional males that are in our community," said Rev. Roosevelt Watkins, Pastors United for Change.

    The fight against violence was top of mind Saturday, but also a growing concern regarding the impending release of dash cam video showing the fatal shooting of 17-year-old Laquan McDonald last October. Officials say he was shot in the back 16 times, some gunshots hitting him after he had fallen on the pavement.

    "Chicago is on the tipping point," Rev. Watkins said. "We can be just like Ferguson."

    Earlier this week a Cook County judge ordered the video be released against the city's wishes. The police officer in question is still on the job on desk duty while the city completes its investigation. The Rev. Jesse Jackson has called for the officer to be indicted and said a top-to-bottom change is necessary in both the Chicago Police Department and the State's Attorney's Office.

    "I have high regard for McCarthy as a person, but his job, he's lost credibility," Rev. Jackson said. "The police department is no longer credible."

    Police say McDonald was carrying a knife. The shooting took place while officers responded to a report of vehicle break-ins in a trucking yard. The dash cam captured the end of the confrontation. Many fear its viewing might spark riots similar to those seen in other parts of the country.

    "As incendiary as this video may be, and we've all heard the rumors, remain calm," said State Rep. Elgie Sims (34th District). "Don't incite violence in our community. Or exact violence on our community. Let's use that energy in a positive way."

    The city has until Wednesday to release the video.

    Chicago Set for Protests Over Shooting by the Police

    CHICAGO — For months, leaders here watched as other cities faced angry demonstrations over police conduct, shootings and relations with black people, often captured in painful videos. As cities like Ferguson, Mo., Baltimore and New York have been consumed by fatal encounters involving the local police that have fueled national attention since 2014, this city managed to keep a lower profile.

    But Chicago now finds itself grappling with the prospect of having its own moment. The city has been ordered to release, within days, a police video of the fatal shooting of a black 17-year-old by a white police officer. Even the officer’s lawyer has described the video, which the city sought for months to block from public view, as “graphic” and “violent” and “difficult to watch at some points.”

    With the memories of discord in other cities so fresh, leaders in Chicago, which has a history of tension over race and policing, have been holding urgent private talks with community activists. Law enforcement officials are trying to anticipate what response the video may bring, and how best to prepare police forces here for that.
    And the mayor, Rahm Emanuel, appeared to try to calm the city, taking the unusual steps of condemning the police officer and urging prosecutors to take action in the case before the release of the video.

    “In accordance with the judge’s ruling, the city will release the video by Nov. 25, which we hope will provide prosecutors time to expeditiously bring their investigation to a conclusion so Chicago can begin to heal,” Mr. Emanuel said Thursday.

    Around Chicago, the video has become a topic of discussion, even though most people have not seen it. According to a few people who have viewed it, the video shows Laquan McDonald being struck by 16 bullets, some of them hitting him even after his body had fallen to the ground along a street on this city’s southwest side in October 2014. Some of the bullets, an autopsy shows, entered the back of his body.

    A lawyer for Mr. McDonald’s family said the video showed him moving away from Officer Jason Van ? , the policeman who fired all of the shots, while at least five other officers never fired their weapons.

    Dan Herbert, a lawyer for Officer Van ? , said his client believed the shooting was justified because he feared for the safety of himself and his colleagues. Mr. McDonald had a knife, the authorities say, and earlier punctured a squad car’s tire with it and refused to drop it. The officers were approaching him, officials said, after the police got a report that a man with a knife was trying to break into vehicles in a trucking yard.

    Officer Van ? is on administrative duty pending an inquiry by a team that includes the F.B.I., the United States attorney’s office in Chicago and the Cook County state’s attorney’s office.

    Since Thursday, when a judge ordered the video’s release and set a deadline of Wednesday, many in this city have begun speculating over how and exactly when the release will occur, and what may follow. Some lawyers, officials and activists wondered aloud whether charges — either from the Cook County state’s attorney or a federal grand jury — might still be possible a day or even a few hours before the video’s release, and how an arrest might affect residents’ responses.

    Prominent Chicago activists said that protests were a foregone conclusion, but that they were not certain yet what form they may take. Charlene A. Carruthers, the national director at the Chicago-based Black Youth Project 100, said she expected the video’s release, whenever it came, to bolster efforts of her group and others to press for changes to the Police Department.


    Page May, an organizer with We Charge Genocide, a Chicago group that has accused the police here of systemic misconduct, said she expected the video to awaken more people to what she saw as widespread police abuses. But Ms. May said she had concerns about the video’s release given that Mr. McDonald’s family has expressed reluctance.

    “The folks that are going to get woke because of this video, we need to welcome them, organize them,” Ms. May said. “The challenge now is how do we organize around this video without adding to the spectacle?”

    The Rev. Michael Pfleger, a Roman Catholic priest and social activist on Chicago’s South Side, said the police “continue to build mistrust” by not immediately firing Officer Van ? and other officers whose actions have resulted in large settlements. In the spring, the city agreed to pay $5 million to the family of Mr. McDonald.

    Father Pfleger said that protests would be necessary after the video’s release, and that organizers were planning what form those should take. He said officials at City Hall called for peace during a conference call with community leaders on Thursday. He said he had also been invited to a meeting with the police in the coming days.

    Police officials said Friday that plans for after the video’s release were still being made, and provided few specifics. Anthony Guglielmi, a spokesman for the police department, issued a statement: “As you have seen over the past few years, C.P.D. works tirelessly to protect people’s First Amendment rights, and residents of Chicago have exercised those rights in a peaceful way.”

    The Rev. Jesse Jackson, whose Rainbow PUSH Coalition is based in Chicago, said he was upset that officials had tried to withhold the video until now.

    “I know it’s a national disgraceful situation, and it will attract people around the country,” Mr. Jackson said, adding at another point, “My greatest fear is not the protest, but if there is no protest.”

    Emanuel to hold meetings Monday to prepare for release of shooting video

    CHICAGO (FOX 32 News) - Chicago Mayor Rahm Emanuel is putting plans into place to deal with expected backlash as the city prepares to release a violent video of a police-involved shooting.

    Last week a judge gave the city until Wednesday to release the video that reportedly shows a white police officer shooting 17-year-old Laquan McDonald 16 times.

    Emanuel will be holding a conference call with interfaith leaders and ministers at 1:30 p.m. Monday. He may also be holding a meeting prior to that with some of the hierarchy in city hall to give them an idea of what the plans might be, FOX 32 has learned.

    There is every indication that the city is very concerned about the release of footage of what took place in those fatal moments when McDonald was gunned down by Chicago police officer Jason Van ? .

    The mayor is expected to also put together a public service announcement that may go on the radio or television and appeal for calm, sources tell FOX 32.

    Mayor To Meet With Ministers As City Prepares To Release Video Of Fatal Police Shooting

    CHICAGO (CBS) — Mayor Rahm Emanuel was meeting with community and religious leaders on Monday, to prepare for the backlash when a video showing a white police officer fatally shooting a black teenager is made public.

    It was October 2014 when Officer Jason Van ? shot 17-year-old Laquan McDonald 16 times on a street in the Archer Heights neighborhood.

    A Cook County judge has ordered police to release dashboard camera video of the shooting by Wednesday.

    Chicago area pastors have said they are concerned about the video’s potentially inflammatory nature.

    “Getting ahead of it, and making sure that we present to the mayor what we expect to happen, I think that’s critical if we’re going to prevent violence from happening in our neighborhoods,” said Rev. Corey Brooks, pastor of New Beginnings Church.

    Brooks and other ministers and activists planned to meet with the mayor at 3:30 p.m. Monday to discuss how tamp down the potential for violence after the video is released.

    While the city originally planned to appeal the ruling to make the video public – and had argued releasing it could jeopardize an investigation of the shooting – the mayor’s office later said the city would comply with the order.

    “We must try to keep this thing as calm as possible, but when the Chicago police take and slaughter a 17-year-old child, you have upset our community,” said Mark Carter, a community activist with the group ONE Chicago.

    Carter said the mayor should lead an effort to make sure the officer is indicted, and should also demand the resignation of Police Supt. Garry McCarthy.

    The mayor’s office and police department have not yet said exactly how or when the video will be released.

    I'm thinking that's what happened as well. I bumped into an attorney last night who works for the law firm that is representing the journalist who initially called for the release of the tape. He's a civil rights attorney, appeared to be a really solid white dude, and he hasn't see it. He said based on his knowledge, he believes that Laquan was walking AWAY as he was shot, and that the officer repeatedly shot into him as he was lying on the ground on his stomach. I don't even think I want to see it right away. I'll wait until after the holidays.
