The Supreme Court on Tuesday upheld a Michigan constitutional amendment that bans affirmative action in admissions to the state’s public universities, in a fractured decision that revealed deep divisions among the justices over what role the government should play in protecting racial and ethnic minorities.
The 6-to-2 ruling effectively endorsed similar measures in seven other states and may encourage additional measures banning the use of race in admissions. States that forbid affirmative action in admissions decisions, like Texas, Florida and California, as well as Michigan, have seen a significant drop in the enrollment of black and Hispanic students in their most selective colleges and universities.
In five opinions spanning more than 100 pages, the justices set out starkly conflicting views. The justices in the majority, with varying degrees of vehemence, said that policies affecting minorities that do not involve intentional discrimination should ordinarily be decided at the ballot box rather than in the courtroom.
But Justice Sonia Sotomayor, in the longest and most significant dissent of her career, said the Constitution required special vigilance in light of the history of slavery, Jim Crow and “recent examples of discriminatory changes to state voting laws.”
Justice Anthony M. Kennedy’s controlling opinion for three justices took pains to say that the decision was a modest one.
“This case is not about how the debate about racial preferences should be resolved,” he wrote, in an opinion joined by Chief Justice John G. Roberts Jr. and Justice Samuel A. Alito Jr. “It is about who may resolve it. There is no authority in the Constitution of the United States or in this court’s precedents for the judiciary to set aside Michigan laws that commit this policy determination to the voters.”

The sad ? is ,there's just as many blacks as there is whites who want to do away with affirmative action. -

? all that....These colleges & universities are businesses that are primarily concerned about a student's ability to pay tuition. I'm living in Texas, originally from New York City & it was so much easier getting into college here, than back home.
Affirmative action has nothing to do with how you pay for school.. You are mixing the issues. It has to do with admissions.. -

I believe one of the goals of affirmative action was to amend for past discrimination so their would have to be a history of discrimination before they could benefit from 'affirimative action'. Being in a minority class in itself does not qualify you alone I believe.

◾In The Shape of the River, written by former university presidents William Bowen of Princeton University and Derek Bok of Harvard University, the authors pointed out that eliminating consideration of race would have increased the likelihood of admission for white applicants at selective undergraduate institutions from 25% to only 26.5%.
◾Given the overwhelming numbers of white applicants, and the factors that tend to benefit socially and economically advantaged students, athletes, and others, Gratz and Grutter (plaintiffs in the lawsuit against the University of Michigan) were more likely disadvantaged by their socio-economic or class status than by their race.

Yeah and also minority is not just the numbers. By my personal definition ...its the wealth, influence and access only one of these will change much

i think i've said this before on here, but i'm actually not a big supporter of affirmative action for colleges...i'm not saying do away with it but:
for one, the name of your college is just a name unless you go or went to an ivy league school with a degree in something worth a damn. go to a junior college first & transfer...you have priority of admission & a better chance than somebody right outa high school.
second, if inner city primary education institutions weren't so ? up then anybody with some drive & consistency will be college bound. more cost effective than sending somebody through who came from that situation having to drop out of college or fall waaaay behind because their formal education didn't prepare them.
that's a long shot tho & it won't happen any time soon.

the action should be strengthening the public schools so that the students do qualify... -

I don't recall making a statement of support or opposition in my OP. Actually upon further reading, you would notice that i make mention of this making us stronger in the long run. -
